the card would just scale down for the 2.0 slot max ability right?

Yes, but most of us and even heavy gaming, there isn't anything that can take saturate any PCIe 2.0 lanes let alone 3.0.
The for the most part PCIe 2.0 already has enough bandwidth that it don't make a diff.

Unless you are doing something that can use all lanes available. I wouldn't worry.

PCI-E 3.0 is backwards compatible with PCI-E 2.0 so as everyone has mentioned, yes.

The only difference is a reduction in bandwidth which does not matter since the performance difference between PCI-E 3.0 and PCI-E 2.0 is null.

PCI-E 3.0 is just a market gimmick at the moment as it offers no performance difference over PCI-E 2.0.

Not Nescessary a gimmick, they just haven't developed anything that can saturate the available lanes yet. But as graphical programs and games advance, it will eventually get there.
But as of right now, PCIe 2.0 works just as good, but PCIe 3.0 is more future proofing. But IMO, by the time comes around again, most of us have probably upgraded again already.

Also they are now also develop PCIe storage devices (we see some already), so as more and more device release that use PCIe, the 3.0 lanes will become more useful as well.

I run my GTX 780 on my PCIe 2.0 X58 classy. Seems fine to me.
The choice is clear I can quit
And fall on my sword or light a fire
To see who runs or stays
    And plays the confidence game
